Wife and I decided to buy house in Sept. We close Feb. 16 2009 can we claim it on our taxes? What about the earnest money paid already paid? She works full time and goes to school at night, we have always claimed her tuition at tax time but have never claimed the books, can we claim from previous years, we changed banks so is there any way of proving that we paid for the books. Some were on amazon, some were at school. We pay about 400 semester on books, and have never claimed them. She has been in school for 5 semesters now. i know about the first time home buyer tax credit interest fee loan, I just need to know bc Hr Block has an estimator calculator and asked if were first time home buyer. Not referring to the interest on house, first time is separate box to check. We have not paid any interest just earnest money. And last question why does hr block ask about stimulus check I thought that was not taxable. It changes our refund by the whole amount

Answer: Books are not deductible.

The rebate is a one time rebate on 2008 income tax. It was estimated on the basis of your 2007 tax return. They ask how much you received because if you are entitled to more based on your 2008 information, you will receive the difference. If you are entitled to less, you don’t have to pay back the extra you received.

The problem is the program they use assumes you got nothing and therefore are entitled to the full amount now. If they assumed you got the full amount already, they would show no change unless you got less than you were entitled to.
