Answer: No, there is no penalty for late filing if a refund is due. Penalties are based upon the amount of the tax debt outstanding. If there’s no debt, there’s no penalty.

Nobody EVER went to jail for late filing of a return. The only penalty is financial and again only if taxes are due.

If a return is missing, the IRS gives plenty of warning before pursuing criminal sanctions for failure to file. They can’t get any money from a jailbird and they’d rather you be able to earn come income and pay them their due.

When I was younger I was stupid and didn’t file a tax return, I got audited and I was actually owed money back but didn’t have any clue how to fill out the forms. Now I owe $2500 and the length of time was about 3 years. I live in MN and was told that if I was due money that there shouldn’t be such a high fee. I had two kids at that time and was low income. I’m just wondering how I can find out what the penalties, late fees, etc… per year for filing late.
i determined i was owed money because for one i had two kids, i was in school, i was working 2 jobs both part-time and every year before and after that i have always received a return. at that time i was also low income, so i doubt i owed anything.
