Question: Can my daughter’s father, who doesn’t have custody, claim her on his income tax for the child tax credit?

He pays 50 a month to welfare because I am on assistance temporarily. He’s only paid for two months. I have full custody, but my husband goes to school full time, no job, and I am not in school because I am in my 3rd trimester. Can he claim her and receive the large child credit? Does he need my permission to claim her? Does anyone know where I can get these questions answered?

Answer: You could sign IRS form 8332 and give him permission to claim her as long as he’s her biological father, but if he doesn’t have any tax liability, claiming her wouldn’t do anything for him. The child tax credit only subtracts from the taxes the person owes, they don’t get any extra back. So if he doesn’t have a job, and doesn’t owe tax, there’s no credit either. If you don’t have any earned income, then claiming her wouldn’t do anything for you either.

Question: I need help figuring out if a qualify for a mortgage and for how much?

I have worked for one company full time since 2004. I currently earn $18hr., but I have only made that one year, prior to that I made $17hr from 2004-2007, then made $14hr for 6 months in 2007-2008.
I also have a second full time job paying 18.5hr. I have worked for this company for 2 years, but only the last year have I earned 18.5hr full time, the year before that I made $12hr at around 24-32hrs a week.
I also have a military pension of $650/month gross.
I have one car payment $410 and one student loan $140, thats all of my bills.
I have $10,000 saved up for a down payment and closing, but I prefer to go with a VA loan with no down payment.
Now this may be the deal breaker. Currently my average FICO is 630 (I had a bankrupcy in 2002). So can anyone run some numbers and let me know if all of my current income would count? THANKS!!!

Answer: The way that we will calculate your income in this type of situation is pretty simple.
We will take the last 2 years w-2s and add them up and divide by 24 months to get an average per month. There is now way to answer your question without that information. Your credit should be fine as long as you have made your payments on time after the bk.

I am an employee who will file annually. How does it work if you want to file jointly as a couple?

Answer: She does not file a tax return quarterly. She does or should send an estimated payment toward her tax liability on a quarterly basis. This is the same thing as you as an employee having money withheld from your pay. At the end of the year you file a Joint Return and use your withholding and her estimated payments to off set any liability you may jointly have.
