Married Filing Separately

Question: MArried filing separately to avoid entire refund to offset wifes student loan default?
Last year our entire refund and stimulus check went to pay off wife’s defaulted student loan. Can I file as Married Filing Separately so that only her refund is taken or will it matter?
Answer: You don’t have to file separately, but that is an option. Another option (which can take longer, but gets both of you more money back if you are due a refund) is to file as an injured spouse (form 8379). That way, you can still get the tax benefits of Filing Jointly, but only her share of any return would be taken- not yours.
Hope that helps. :0)

Tax Filing Status Head Of Household

Question: I am filing a tax return from a previous year and I am unsure what my filing status would be?
I was living with my boyfriend(now my husband) who is a British citizen so he doesn’t need to do anything wiith a US tax return. So, would I be considered head of household or single? I was living in the UK at the time which I still do.
Thank you for your helpAnswer: If you were married by the end of 2007, you file as Married Filing Separately or Married Filing Jointly.
Most people file Married Filing Separately as you don’t want to mix up his finances with yours – in my case, my husband makes more than me so it wouldn’t be beneficial.
Even though he has no requirement to file (he has no US-sourced income), he needs to apply for and receive an ITIN number, which can be done at an IRS office.
You’ll need his number, and your income to file – then, assuming you have less than $85,700 in income yourself, you file both the 1040 and form 2555-EZ.
