Question: Filing Joint Tax Return with Deported Spouse?

My spouse was deported to nigeria but I still provide finiancial support. Can we file a joint US tax return or can i claim him as a dependent

Answer: There is no residency requirement for a spouse.
Your spouse is a non-resident alien due to being deported before the end of the year.

If you have children, you *might* qualify for HOH status–but if you were living together, you do NOT qualify for EIC.

So, you have 4 possibly ways to file:

1. Married Filing Jointly. There is no residency test for a spouse. You would declare worldwide income, need a W-7 (if no SSN or ITIN) and their signature to file.

2. Married filing separately claiming his exemption if he had $0 US income. (This is techinically different than claiming him as a dependent, but the math works the same.) You get to claim the $3500 exemption. Still requires W-7.

3. Married filing separately without claiming his exemption. If there is no SSN or ITIN, you file a paper return and mail it in. Since you are not claiming a benefit, you do not need a number.

4. Head of Household. If you have a minor child living with you and you paid for more than half the cost of your household, you can file HOH. If your husband was living with you after 6/30, you can file HOH because he was deported, but NOT for EIC purposes. If your husband was deported before 7/1, you can file under the regular HOH rules.
