Question: PA National Guard Pay for state income tax, taxable or non taxable?

My husband is in the PA NG and he has a full time job there (he is AGR). His W2 has PA state wages and PA state tax withheld, but turbo tax asked me if this is supposed to be taxable since he is in the military. No he was not deployed and did not serve in a combat zone at all in 2009. Is full time NG pay taxable for the state of PA? Or should I say exempt and get a refund of the tax he paid in?

Also his local tax box on his W2 is blank, so I am assuming that his pay is non taxable? It has been my professional knowledge that local taxability always follows state, expect for certain items such as church housing etc.

I work for a tax preparation company and can tell you that sometimes military tax returns can be confusing. My husband is also in the PA National Guard but was deployed in 2009. Let me try to help you out. (By the way, this is my first “Yahoo answer.”)

It sounds like your husband’s wages will be fully taxable for federal and that you should enter all wages in box 1 as taxable. (If he were deployed in a combat zone those wages would not be taxable. The W-2 would not include them in box one; the nontaxable combat pay would appear elsewhere in the W-2.)

The same goes for Pennsylvania. All wages in box 16 will be fully taxable. The only difference is that if your husband worked outside of PA for any time in 2009, those wages would not be taxable to the state of PA. You’ll have to look at the numbers as reported on the W-2 to figure this out.

As for local taxes – he is responsible for paying them. DFAS does not withhold local tax. You can contact your local tax office for the forms. They can even help you figure out how to do them. The tax due to them would be a percentage of the local wages included in box 18. Many PA guardsmen owe local taxes due to DFAS not withholding. My husband always owes in for this.

Answer: Go to irs.com and print out an extension form 4858, send it today April with a good faith estimate. If you cannot pay, the gov will fine you, etc, and set up a payment plan

OR if your taxes are done, send them in today April 15, even without the payment to avoid some penalties. then line 2 above.

Question: Question regarding Injured Spouse form?

I have recently found out that my husband has defaulted on a student loan and the irs will keep our tax return. We have since called the lender and began a repayment plan to rehabilitate his loan. I was told that we can file an injured spouse form to be able to get some of our return back. I (the injured spouse) made all of the our income for 2009, but live in AZ (a community property state)…

Answer: When I filed an injured spouse claim last year in TX(another freaking community property state) they split our refund down the middle. I didn’t work(I was the injured spouse) and we got exactly half of the original refund. They may allocate it differently since you are the one with all the income but that is what happened in my experience

Question: California tax extensions?

Hi. I thought that the deadline for filing for a federal tax extension, and the dealine for the california state extension were the same. Then I heard from someone that they’re not, and that the CA extension had to be filed a day earlier. Is this right? I’m not sure what to do now. Also, is it possible to file a california extension a day late (4/17), or can I just not file an extension now? If it’s too late, what will the penalties be? Unfortunately, I do owe money, although not a lot. Thanks!

It is a automatic extension for CA state, but you have to pay money to IRS before due date, if you owe money. Otherwise there may be penalty and interest. Check CA state FTB site for this. http://www.ftb.ca.gov/

Question: Will the postal service forward your IRS refund check if you have a chage of address? Or does it go back?

I recently moved from one city in Ga to another and I called the IRS and the Postal Service and neither of them could tell me if my refund check would be forwarded. I have a change of address in with the post office, but I am not sure if the envelope from the IRS says” Do not forward” Thanks.




Answer: As long as you have a valid change on file it will be forwarded. And yes we do forward W2′s also.
