Question: Question regarding Injured Spouse form?
I have recently found out that my husband has defaulted on a student loan and the irs will keep our tax return. We have since called the lender and began a repayment plan to rehabilitate his loan. I was told that we can file an injured spouse form to be able to get some of our return back. I (the injured spouse) made all of the our income for 2009, but live in AZ (a community property state)…
If I file with the 8379 form, will they keep EIC? Child tax credit (we have 3 children)?
Does everything get split 50/50?I was also advised to file an extension and wait til the loan has been rehabilitated to file our taxes…
Will the offset be removed once the loan has been rehabilitated?

Answer: When I filed an injured spouse claim last year in TX(another freaking community property state) they split our refund down the middle. I didn’t work(I was the injured spouse) and we got exactly half of the original refund. They may allocate it differently since you are the one with all the income but that is what happened in my experience

Question: California tax extensions?
Hi. I thought that the deadline for filing for a federal tax extension, and the dealine for the california state extension were the same. Then I heard from someone that they’re not, and that the CA extension had to be filed a day earlier. Is this right? I’m not sure what to do now. Also, is it possible to file a california extension a day late (4/17), or can I just not file an extension now? If it’s too late, what will the penalties be? Unfortunately, I do owe money, although not a lot. Thanks!

It is a automatic extension for CA state, but you have to pay money to IRS before due date, if you owe money. Otherwise there may be penalty and interest. Check CA state FTB site for this. http://www.ftb.ca.gov/

Question: Late S Corp Tax Return – Should I Files Extension Now?
I spaced out our S Corp return which was due March 16th thinking it was due April 15 with personal taxes – spouse and I are only employees and shareholders. We were going to file an extension because it is allowed to make profit sharing contributions for the previous tax year (in this case 2008) until the extended due date of the return. This would save us several thousand on taxes and get stock bargains at this point.
I am anxious today that I remembered I am a MONTH late almost with the corporate tax return. Can you still file for an extension and get it for a corporation?
We don’t owe any corporate taxes, so it is really a matter of the consequences to our personal taxes. I’m stressed! Any advice or good, solid tax knowledge out there?
Answer: The date for filing an extension was March 16, but you need to have the corporate return prepared to get the K-1 for your individual taxes.
If you do not owe for the corporation there is no late filing penalty.

i did my taxes this yr on some online site and i must of screwed something up because the IRS or California never received my returns so can i still file an extension?
or do i have to wait until next yr ?

Answer: You can not receive an extension if you have not file for that extension by April 15th. You should file your return ASAP and it is helpful to do so before Oct. 15th.
