Question: If I efile today for an extension on my taxes, when they are complete can I still efile them?

In other words–does filing for an extension make it mandatory to mail in a physical return or can I still efile my return when complete, say next week or next month?

Question: Filing tax deadline and extension question… Is it automatic?

Last year, I knew I wasn’t ready at April 15, so I asked my CPA to file for an extension. Got an invoice from CPA for $35. Then I checked online somewhere, I think it said everyone’s Tax Filing Deadline is automatically extended, if one didn’t file on time. Is this true? Did she just charge me $35 for doing nothing? If I want to file an extension but have her prepare my taxes, can I do that?

This year, I’m not sure if I’ll be getting a refund, as I will be reporting larger than last year’s earnings. Do I have to pay in advance if I’m ready to file for an extension (or is that truly an automatic thing?), or can I just pay when I file after April 15?

Answer: As strange as this may sound, you do have to file a request form to receive the automatic extension.

You have to file “Form 4868, Application for Automatic Extension of Time To File U.S. Income Tax Return”:

Be aware this extension applies only to filing your tax forms. It’s not a extension for you having to pay your taxes. If you are late paying your taxes, they can still charge you late penalty fees.

Question: Does tax form 2350 extend state AND Federal Tax Filing date?

I worked in the state of Colorado in 2009, but then moved to the UK in August and worked there. I realize I need to file form 2350 to ask for an extension in order to qualify for the Foreign Earned Income Exclusion, but once I do this, does it extend the federal AND state tax, or just federal? If its just federal, can I file state taxes as normal? Do I have to include foreign earned income on state taxes at all?

Answer: You’ll have to check with the CO DoR. Some states automatically grant any approved Federal extensions while others do not and require a separate extension application. (And most states don’t grant the foreign earned income exclusion so the 2350 extension would be moot. In this case you’d need to file the CO return on time.)

Some states (MO for example) grant an automatic extension if you file a Form 4868 Federal extension. The 4868 gives you a full 6 month extension. Since you moved in August you’ll meet the 330 day test in July so filing Form 4868 will cover you for the foreign earned income exclusion just as well as the 2350 does. The only time you’d need to use the 2350 is for an extension past Oct 15th which isn’t necessary in your case.

Also bear in mind that neither Form 2350 nor 4868 gives you an extension of time to pay any tax due. You get a 60 day extension to June 15th since you reside outside of the US but penalties and interest will accrue from that date on if any tax is due when you do file. For this reason be SURE to enclose payment in full for any tax that you will owe once you do file.
