Answer: There is no filing status “divorced”. Once your divorce is final, you are single. On your tax return, you use the status that applies on December 31 of the year you are filing. If you divorced by 12/31/06, your status for 2006 is single. If you divorced 1/1/07, your status for 2006 is married (Filing Jointly or filing separately). If you have one or more children, the situation is a little more complicated.

Question: Is it illegal for a wife to file a joint tax return without her husbands knowlege and keep refund?

My brother and his wife have been seperated over a year and have filed for divorce. Just recently my brother found out his wife filed a 2007 tax return with him as head of household and received 0ver $2,500.00 refund. He never seen the tax return or signed anything or received any of the refund. What should he do?

Answer: He should mention this to his lawyer and make that money part of the divorce settlement. I believe he’s entitled to half (at least) since she filed and obviously forged his signature without his knowledge.

had tax data in computer but computer crashed. got it back up and am 200000 in debt with child support and credit cards after two years of divorce. What can I do as I just was able to print the sheets out and have to go file and know that I will have to pay another 3000.00 this year and I am so far behind all ready. Please help

Answer: contact the irs and they can send you an income sheet for that year for free, if you want to whole return they’ll charge a small fee..

like the other guy said, consider backing up your personal files so you have hard copies….

Question: Small business hasn’t filed taxes for seven years-what to do?

I do bookkeeping for a small business that has not filed federal taxes for seven years. The owner is a sole proprietor and does file and pay state taxes quarterly. He calls me today, tax day, and wants to file his 2008 return. While I have the receipts separated and totaled for expenses and income, I think he needs to get tax advice from a CPA or possibly even a tax lawyer. Plus, if he files today, won’t that alert the IRS that he is behind and have them get on him right away? He wants to file and pay everything, but I think he needs professional advice. Any suggestions?

Answer: He should have thought of this before today. 4 years from when a return was due he won’t get any refunds but will owe the taxes if due.

He needs to file one year at a time he can file today’s return but he can just send a check with an extension and do it later. I would file today then amend so he doesn’t get failure to file penalties. Then go back to the first year he missed and start doing the returns. His tax bill will be huge but not complicated. Since he filed his state taxes he has his records. I would get everything ready then have him take them to his account for review. A CPA or tax attorney might make him feel more sure but an enrolled agent should be able to handle it.
