Question: my husband and i filed head of household on our tax returns can we get in trouble when we file bankrupcy?

we were seperated in 2008 but now are together

Answer: If you weren’t together at any time between 7/1/08 and 12/31/08, and each of you had at least one child living with you and provided over half the cost of maintaining your household, then you could both file as head of household. If one of you didn’t meet those rules, then that person couldn’t file as HofH, even if that person claimed a child as a dependent but the child didn’t live with him or her over half the year.

Your filing status and bankrupcy are unrelated, but if one or both of you filed as HofH and didn’t qualify to, that person needs to amend their return.
