Question: Late Tax Filing?

Is there a penalty for filing your taxes late if you were supposed to receive a refund? (Like say your spouse said they would file your 2006 return and you go to file you 2007 and find out that they didn’t do it…..) (Yep, sorta angry)

Answer: The penalty for late filing is based on the amount of tax due. Thus, there is no penalty if you are due a refund. Of course, you have lost the use of that refund while you were waiting.

You have up to 3 years to claim your refund. That is, your 2006 filing (originally due 4/15/2007) must be claimed by 4/15/2010.
