Question: cannot cash irs Tax Refund check?

my wife has been hospitalized since july 2010.
she has had multiple heart attacks & a trachea surgery performed on her throat.
filing married jointly is no problem. i can do this online with free e file.
my question is how can i cash her check since she is paralyzed & has no use of her hands.i need to help pay her medical bills.
thanks for any help.
remember,she has no use of her hands & she cannot make an X.
she does not have a bank account. only I have one.

Answer: If she is disabled, you must have Power of Attorney for her, correct? If so, you are legally authorized to sign her name on her behalf.

IRS says:

Q. Who can sign a tax return if the taxpayer is mentally or physically unable to sign it?

A. If the taxpayer is mentally incompetent and cannot sign the return, it must be signed by a party with a valid power of attorney or a court-appointed representative who can act for the taxpayer. If the taxpayer is mentally competent but physically unable to sign the return or POA, a valid “signature” is defined under state law. It can be anything that clearly indicates the taxpayer’s intent to sign. For example, the taxpayer’s “X” with the signatures of two witnesses might be considered a valid signature under a state’s law.

Question: debt payments while in school?

I am a 21 year old student, no income, just $3,400 left over from my student loan money for this semester. Have two debts -
1) Credit Card=$2,300
2)Car Loan=$1,700

What can I do, as I don’t really want a job, and I am relying on my student loan money and possible Tax Refund check of $500 hopefully soon. Also, the goverment’s stimulus package of $600 will hopefully help, but that won’t come until May. Any advice? Consolidations? I don’t want to do bankruptcy? Can I “sell” my credit card?

Answer: First of all, cut up the credit card then contact the card company and close the account, you should not have credit with no income to repay it. You can make an arrangement with the company to make minimum payments to keep your credit score unaffected. When you get any refund you should apply it to reducing this debt, and seriously think about getting a job and living on cash only. Your car loan must be paid regularly or it will be repossesed and that will negatively affect your credit for 7 years. Your total debt is too low to qualify for consolidation or bankruptcy and they are legal remedies to be used when all other means have been exhausted. You will not be able to get credit for many years afterwards.

Question: what to do if income tax return is filed with tax payable & that tax paid at later date?

This is a query related to late payment of self assessment tax. I had asked a consultant to file my income tax return. It seems I suppose to pay some amount, but he filed my return on 31st July by mentioning that amount as tax payable. Then he asked me to pay that amount plus some interest amount for that month, so I paid it in a bank on 9th Aug & received the counterfoil. I then asked the consultant to get acknowledgement endorsed that tax payable is already paid. But he said there is no such thing called endorsing acknowledgement. He said I just need to keep both acknowledgement & counterfoil with me. And produce those if income tax department ask for it in the future time.

Is this process correct that I just need to keep both acknowledgement & counterfoil with me? or should I need to get my acknowledgement endorsed for the tax paid ? Please let me know the process.

Answer: You (may be through your consultant) can write letter to the concerned official and attach Xerox copies of the paid challan.
The acknowledgement of letter will be sufficient.
I hope it will serve the purpose.
By the way, what your consultant told is also correct.

I DONT GET IT? WHAT DOES THIS MEAN?!! HELP, PLEASE!

Answer: It MEANS they’re still reviewing your application – and/or you must remit your parents tax returns from the previous year, along with the DVWS form, before you will be eligible for financial aid.

And thus, don’t be expecting “a check” anytime soon.
