Recently Married Filing Taxes

Question: Recently deceased father married to illegal alien what filing status(tax)do I use?They never lived together.?
We believe the marriage was for her citizenship, they never lived together and did not have sexual relations. They have been married for 3 years and the deceased father has claimed “INDIVIDUAL” on his past three 1040′s. Should I continue to file individual or married filing separately? We have been urged by family to file individual because she may get deported. Also, if we file individual there will be a refund and the money will then go to the deceased father’s son. Could this come to bit the son later if he cashes the refund?
