Question: question abiut Tax Refund in vancouver canada..here is the story my husband had a working visa?

at burnaby hospital in canada.. my question is , is that true that when he declared his son as dependent without any documents like marriage certificate and birth certficate, do you think he can get a high tax refund ?i need exact answer and thank you….
but we never been together since i give birth to my son,he just only visiting us in my country phils..we have the marriage certificate but he refused to submit it. only the birth certificate of my son he needed, just to get a high tax refund for him.. do you think there is a posibilty he will not questionable?




Answer: You can claim higher tax refund for the child if you are indeed married (common law) or has a child, and the child has negligible income for the year.

You can be considered “married” for tax purpose without a marriage certificate if u both live “common law”, meaning that you both are living in a conjugal relationship for at least 12 continuous months.

Without a birth certificate, you must have document proof that the child is indeed yours, or u or your common law spouse adopted the child. You or your spouse can only claim the child if a child born in 1991 or later, and the child resides with both parents throughout the year. Either parent (but not both) may claim $2,038 per child. Any unused portion can be transferred to that parent’s spouse or common-law partner. If the child does not reside with both parents throughout the year, the parent who is entitled to claim the amount for an eligible dependant can claim the child amount.

RE YOUR ADDITIONAL DETAILS:
As I indicate above, the child must reside or live with both parents throughout the year in Canada before he/she can claim the child as a dependent for tax purposes. It would be a mistake, or warrants a penalty if found by the CRA to be knowingly amounting to gross negligence, for him to claim this child if the child does not reside with him.
