Everyday I get quite a few questions regarding the American Recovery and Reinvestment Act of 2009 and how it would apply to buying a home using VA financing.
For those of you that don’t know, this act was initially passed as a “tax credit” to first time home buyers up to $8000 dollars.
Many groups like the National Association of Realtors petitioned lawmakers to monetize the tax credit which would allow buyers to use the credit as a form of down payment.
Using a tax credit as down payment mainly benefits FHA borrowers.
With a VA loan, borrowers already have 100% financing in place. Conversely, the FHA requires purchasers to make a 3.5% down payment. In those cases, a monetized tax credit could be used to offset closing costs and related transaction fees.
Technically speaking – VA borrowers could use the tax credit to buy down the VA funding fee.
The traditional VA funding fee is 2.15% for 100% financing. If a veteran puts more than 5% down in the transaction, the VA funding fee drops to 1.25%. For this to work with as little down payment as possible, the home purchase price would have to be $160,000 or LESS. Furthermore, this strategy only makes sense for Veterans intending to put the 5% down regardless of the situation. Otherwise, putting 5% down to save less than 1% in a VA funding fee is crazy.
A word of caution to all VA buyers.
Just because HUD may allow buyers to use tax credits as down payments, your bank may not. So, regardless of what people tell you, the BANKS make the rules. If you plan on using the tax credit in addition to your down payment, consult with your bank first. Failing to do so could result in a rude awaking. At the time of this writing, most banks DO NOT have a system in place for honoring down payment tax credits.

First-time home buyers who purchase homes between January 1, 2009 and December 1, 2009.
To qualify as a “first-time home buyer” the purchaser or his/her spouse may not have owned a residence during the three years prior to the purchase.
Which Properties Are Eligible?
The 2009 First-Time Home Buyer Tax Credit may be applied to primary residences, including: single-family homes, condos, townhomes, and co-ops.
How Much Will the Credit Be?
The maximum allowable credit for home buyers is $8,000. Each home buyer’s tax credit is determined by two factors:
The price of the home—the credit is equal to 10% of the purchase price of the home, up to $8,000.
The buyer’s income—single buyers with incomes up to $75,000 and married couples with incomes up to $150,000—may receive the maximum tax credit.
If the Buyer(s)’ Income Exceeds These Limits, Can He/She Still Get a Credit?
Yes, some buyers may still be eligible for the credit.
The credit decreases for buyers who earn between $75,000 and $95,000 for single buyers and between $150,000 and $170,000 for home buyers Filing Jointly. The amount of the tax credit decreases as his/her income approaches the maximum limit. Home buyers earning more than the maximum qualifying income—over $95,000 for singles and over $170,000 for couples are not eligible for the credit.
Will the Tax Credit Need to Be Repaid?
No. The buyer does not need to repay the tax credit, if he/she occupies the home for three years or more. However, if the property is sold during the three-year period, the credit will be recouped on the sale.

Question: How do I file my taxes if my spouse in not American & living abroad while I lived in the States?
I got married to a foreigner (Canadian Citizen) June 18th, 2007. For the entire year of 2007 he lived and worked in Canada and I lived and worked in the U.S.
I assume I have to file married but I’m not sure how to go about it. I’ve done some research and I see that I can file Married filing Separately and that he has to fill out some form called 1040NR. Still I don’t understand the implications. Will he have to pay U.S taxes on his Canadian income? Will I have to pay more taxes because the US will combine our incomes? What do I do?

Answer: You have an option to choose MFJointly status. If you make this choice you as a couple will be taxed on your worldwide income. If you do that you can take a credit for taxes that your husband paid abroad.

Some think the importance of dining tables is used only for meals. While this might be true, there are other uses as well. Many women find the dining table as a sort of meeting grounds. I can’t recall how many times my mom and I have sat down around the table to discuss the things that are going through my mind. There are the times that you just meet up for a midnight snack at this table. Yet, it’s also the place to socialize at. Our extended family has joined at this table. Everyone has had their fair share of holiday fun. People have talked about what they did that day or what was bothering them. I think we all recall a time that we sat until we were numb.
Dining tables are also the work station. The children in my family have all done their homework at the dining room table. Mom folded laundry at this table as well. Meals were shared here, but they were also shaped here as we chopped vegetables and more. It was also considered the cooling station for pies and cookies.
At times, dining tables are more than just the workstation. They are for storage as well. You always knew in our family that since mom had a sore hip, you put everything on the table. You put your library books that needed to be taken back on this table too.
Yet, this table also had the purpose of celebrating the holidays. There were times we would put newspaper down to carve pumpkins for Halloween. There were times we’d lay the paper down again as we died Easter eggs. We made ornaments for the Christmas tree at this table.
This was also where dreams were formed. I wrote my first article at the dining table. My sister passed her first test when she studied her words at that table. We did science projects and more at that table. Everyone accomplished something like my college applications and more at that table.
Dining tables can be new. They might be picked out by the newlyweds. The now married husband and wife. The table could be older than the kids. However, it’s more than just a table to eat at. Many can say that these tables are where families are formed. It’s where they learn to communicate and they learn to grow. It’s where living takes form.
While you might think of all the consumer reasons for needing a new dinging table, think about the personal touches. Don’t let your search for dining tables are just for the heck of it or because the other one broke. Make it something that you keep up and pass on. It might sound a bit sentimental, but it’s not really. It’s about keeping something in the family.

Question: Filing extension for previous year taxes
A friend got a letter from the IRS because his wife failed to report a w-2 on a previous year return. He needs an extension on this deadline in order to get her to sign the form as she lives 500 miles from him now. Is there a way to do this online? The number they gave him doesn’t go through. He keeps trying.

Answer: You can’t get an extension, call IRS at 1-800-829-3009 and discuss your situation. No you can’t do this online, Sound like your friend received a CP2000 here is instructions on how they should respond.
Should I call with my response or mail it in?
