Question: What is the penalty for filing state taxes late in Hawaii?
In Hawaii, there is an automatic 4 month extension – I though it was 6 so I waited but realized my extension was over a few weeks ago. I will definitely get a refund on my taxes, but am wondering what kind of penalty I can expect for filing late? Is the penalty something I have to figure out on the form or does the gov’t figure it out? (
Answer: Penalties for filing tax returns late on a federal or state level depends if you owe taxes or not when you eventually file the return. If you had no tax due or expect a refund/overpayment you will not be subject to a penalty.
If you “do” owe tax, their are two penalties you may be subject to:
5% of the unpaid tax per month up to 25% (late payment penalty) AND
5% of the unpaid tax per mont up to 20% (late filing penalty)
