Question: How do I file my taxes if Im married to an illegal alien?
So, this situation is a bit more complicated.
I’m a US citizen and she is an illegal alien, however, she entered this country under a VISA that has now expired. She has a Social Security Number that is legitimate an was assigned to her while she was still a legal non-resident alien. Last year we started working for the same employer, she gave them her SSN, and she received a W2.
Should we file together, should we include her w2? We are in the process of changing her status to a permanent resident. If we file our taxes with her W2, will this affect her application for a green card? I’m really worried to do the right thing. I would hate to show up to that dreaded immigration interview to be told that my wife wasn’t supposed to be working and her green card will be denied!
She has paid all of her taxes, since she used her SSN – would the IRS care if she doesnt file? Would immigration care?
Answer: Once she overstayed her visa she was out of status and she has not legal right to work, and I think you already know that. As an illegal she has no right to work or live in the USA, However for her not to file taxes while working well she will be in trouble, then again she will be in trouble for working when she is not suppose to; so yes they will care that she has not filed. And, probably it will come up at her interview why she was working illegally and not filing taxes.
You need a lawyer and if you do not do this the ‘correct’ way it could affect her green card application.
